In a revelation that blurs the lines of campaign finance ethics, the Democratic National Committee (DNC) has reportedly paid significant legal fees for President Joe Biden during the special counsel investigation into his handling of classified documents. This move mirrors the actions taken by the Republican National Committee (RNC) for former President Donald Trump, which Biden's campaign has previously criticized.
According to Axios and confirmed by Fox News Digital, the DNC has disbursed over $1.05 million from July 2023 to February 2024 to cover Biden's legal expenses. These payments were directed to Bob Bauer, former President Barack Obama's attorney, who is also the husband of senior White House adviser Anita Dunn. Bauer's law firm, along with other legal representatives, received payments to manage the fallout from the discovery of classified documents in Biden's possession.
This financial backing came as part of the investigation led by special counsel Robert Hur, which began in January 2023 after classified papers from Biden's vice presidency were found at his Delaware home and former office. Despite the seriousness of the probe, Hur ultimately decided not to pursue charges against Biden.
The DNC's decision to fund Biden's legal defense is particularly notable given its previous condemnation of the RNC's practice of covering Trump's legal expenses. In past statements, the DNC has positioned itself as a more ethically driven organization, claiming it does not use grassroots donors' money for legal bills. DNC spokesperson Alex Floyd emphasized this stance, telling Axios, "There is no comparison — the DNC does not spend a single penny of grassroots donors' money on legal bills."
Despite these claims, the reality of the DNC’s financial contributions has sparked debate over the transparency and ethicality of such support. Critics argue that the action contradicts the DNC's public denouncements of similar practices by the RNC. In 2021, when the RNC began covering Trump's legal costs related to various civil and criminal probes, a DNC spokesperson criticized the move, suggesting that RNC donors should be questioning where their contributions were going.
The payments to Biden's legal team were also strategically timed. The DNC increased its monthly payments to the law firm Hemenway & Barnes from $15,000 to $100,000 starting last July, as part of the ramped-up effort to manage the legal complexities Biden faced.
The funding has not only covered Bauer’s fees but also facilitated the involvement of David Laufman, a veteran lawyer and former Justice Department official known for handling high-profile investigations. This comprehensive legal strategy underscores the serious nature of the allegations Biden faced and the DNC's commitment to supporting him through the legal process.
As the political and legal drama unfolds, the DNC's and RNC's actions highlight the ongoing debate over the use of campaign and donor funds for personal legal defenses. While both committees have defended their practices as necessary for protecting their respective party leaders, the public and political opponents continue to scrutinize these decisions, questioning the precedent they set for future legal and ethical challenges in political campaigns.
